Information for North Dakota employee marital status

This notice is to inform you that under the North Dakota (ND) law, all withholding elections must be consistent for both federal and state income tax withholding. 

Beginning June 9, 2022, ADP® will use employees’ federal withholding elections for state withholding in North Dakota.  Employees will not be permitted to make different withholding elections for state income tax withholding in ND. Any changes to these withholding elections must be made using IRS Form W-4 and will be effective for both federal and ND income tax withholding. 

Any employees who currently have withholding elections in ND that differ from federal will be updated so that the federal withholding elections will be used for both federal and ND income tax withholding calculations. This change will take effect for payrolls processed on or after June 9, 2022.

We recommend that you notify these employees in advance of this change and advise them that they may make changes to their withholding elections via Employee Self Service: Myself > Pay > Tax Withholdings.
