Montana amends military protections

Montana has enacted legislation (House Bill 590) that requires employers to provide employment protections to service members on voluntary or involuntary orders. House Bill 590 is effective immediately.

Background:

The Montana Military Service Employment Rights Act (MMSERA) provides employment protections to members of the Montana organized militia or federal reserves that are called to state or federal military duty when they are not covered by the federal Uniformed Services Employment and Reemployment Rights Act (USERRA).

House Bill 590:

House Bill 590 amends the MMSERA to clarify that the employment protections apply regardless of whether the service is voluntary or involuntary.
