48 State-Specific HR Compliance Changes for 2026

Employers will continue to face increasing state and local legal requirements in 2026. New rules span employee leave, artificial intelligence (AI), background checks, wage and hour requirements, discrimination protections, employee notices, pay data reporting, pay transparency, workplace safety and more.

Gender/Sex Field and Reporting Updates

ADP regularly reviews and enhances products based on best practices and compliance requirements. Practitioner field labels have been updated in the Personal Profile and also in Reporting. These label updates clarify field functionalities and support practitioners' compliance with mandatory workforce-related reporting obligations to federal and state governments. The changes especially benefit multistate employers who gain enhanced flexibility to collect and report workforce data in multiple jurisdictions that may have conflicting requirements. 

Helpful Hints for Handling No Call/No Shows and Job Abandonment

When employees fail to report for work without notifying their supervisor ("no call/no show"), an employer can be left scrambling to find a replacement. Maintaining productivity levels might also be difficult. The situation can become more frustrating and costly if it happens more than once or with more than one employee. And after a number of no calls/no shows, an employer may consider the job abandoned. To address these situations, employers may include job abandonment guidelines in their attendance policies. Here are some points to consider when drafting and enforcing such provisions.

ACA Approvals Reminder: Who is filing your 2025 ACA Reporting?

If you are an Applicable Large Employer (ALE)*, your business could face significant IRS assessments if your Affordable Care Act (ACA) reporting forms 1095-C for the 2025 reporting year are not timely distributed to your full-time employees.  Please review and acknowledge your filing in the ACA IRS & State Reporting Tool by January 31, 2026, so that we can timely distribute the forms to your full-time employees. ACA Reporting is filed under your unique FEIN.

Minimum Salary Requirements for Overtime Exemption in 2026

The federal Fair Labor Standards Act (FLSA) requires that employers pay non-exempt employees overtime for all hours worked in excess of 40 hours in a wrkweek. Some states require overtime in additional circumstances. However, there are federal and state exemptions from these requirements for employees who meet certain salary and duties tests. Here are some key points to know for both federal and state exemptions from overtime for 2026.
