Action Item #1: Review and approve Affordable Care Act (ACA) forms
If you are an Applicable Large Employer (ALE)*, you need to file Forms 1094-C and 1095-C with the IRS and mail Form 1095-C to your employees by January 31st. Don’t worry -- ADP TotalSource® has created your 1095-C and 1094-C forms for you. All you need to do now is review and approve them.
ACTION REQUIRED
Step 1: Log in to ADP TotalSource and go to Process > ACA > Health Compliance
Step 2: Review your Forms 1095-C in the Ready for Approval bucket and click Approve All when you are comfortable.
Step 3: Review your Form(s) 1094-C in the Ready for Approval bucket and click Approve.
*** If you have any forms in the “Needs Review” bucket, please contact your HRBP for assistance.
That’s it! We’ll handle the rest.
ADP TotalSource will:
- Issue the Form 1095-C to your employees and transmit the required information directly to the IRS on your behalf.
- Provide your employees with instructions about including the Form 1095-C with their tax return.

*If you had an average of at least 50 full-time employees (including full-time equivalents) in 2017, you are an Applicable Large Employers (ALEs) under the Affordable Care Act (ACA).
Action Item #2: Review EEO data and complete your company EEO-1 Report Questionnaire
If on December 31, 2018 --the ADP TotalSource EEO Snapshot date -- you had at least 50 permanent employees (full-time and part-time), you may be required to file an EEO-1 Report*. Starting January 7th, a compliance alert will appear when you log into ADP TotalSource directing you to the EEO Questionnaire to assist in assessing your company’s responsibility to file.
ACTION REQUIRED:
Step 1: From ADP TotalSource, go to Process > HR > TotalSource Compass. Select EEO.
Step 2: Answer the 2 prompts of the EEO-1 Questionnaire.
Step 3: That’s it!

*What is the EEO-1 Report?
The EEO-1 Report is a compliance survey mandated by federal statute and regulations. The survey requires company employment data to be categorized by race/ethnicity, gender, and job category. The U.S. Equal Employment Opportunity Commission (EEOC) uses EEO-1 data to support civil rights enforcement and to analyze employment patterns within companies, industries, or regions. The Office of Federal Contract Compliance Programs (OFCCP) system uses statistical assessment of EEO-1 data to select facilities where the likelihood of systematic discrimination is the greatest.
Generally, an employer is required to file an EEO-1 Report if:
- It employs 100 or more employees (single location or as part of an affiliated/centrally owned enterprise); or
- It employs 50 or more employees and
- has a prime contractor first-tier subcontract of $50,000 or more with a federal agency
- is a depository of federal government funds
- is an issuing and paying agent for U.S. Savings Bonds and Notes
