New Mexico - The City and County of Santa Fe increase living wage

The living wage in the City and County of Santa Fe, New Mexico will increase to $12.32 per hour on March 1, 2021.

Covered employers:

Employers required to have a business license, or registration, in the City and County of Santa Fe, New Mexico, must pay all employees at least the applicable living wage. The living wage for the County and the City increases from $12.10 to $12.32 per hour, beginning March 1, 2021.

Tipped Employees:

The city and county permit an employer to take a tip credit toward its minimum wage obligation for employees who customarily receive more than $100 per month in tips. The tip credit is equal to the difference between the required direct cash wage for tipped workers and the living wage rate. If the employee's direct cash wages and tips don't meet or exceed the living wage, the employer must make up the difference.

Notice Requirements:

Employers in both jurisdictions are required to post, in a prominent location next to the business license, a notice of compliance with the Living Wage Ordinance. The posters must be in English and Spanish, and they may be accessed here.

Compliance Recommendations:
