Nevada adds kin care leave law

Nevada has enacted legislation (Assembly Bill 190) that requires employers to let employees use accrued sick leave to care for an immediate family member. Assembly Bill 190 takes effect Oct. 1, 2021.

Assembly Bill 190:

If an employer provides paid or unpaid sick leave, the employer must provide kin care leave and let employees use accrued sick leave to assist an immediate family member with an illness, injury, medical appointment, or other authorized medical need to the same extent and under the same conditions that apply to the employee when taking sick leave.

An employer may limit the amount of kin care leave to the amount of sick leave the employee accrues during a six-month period.

Immediate family members include: a child, foster child, spouse, domestic partner, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent, stepparent, or a person for whom the employee is the legal guardian.

Poster requirements:

Assembly Bill 190 requires covered employers to post a bulletin created by the Office of the Nevada Labor Commissioner in a conspicuous location in each workplace.

Nonretaliation and enforcement:

Employers are prohibited from denying employees their right to use kin care leave or retaliating against those who exercise their rights under Assembly Bill 190. Violations of the law may result in being found guilty of a misdemeanor and penalties.

Compliance recommendations:

Covered employers should update their sick leave policies and procedures and post the Nevada Labor Commissioner’s bulletin to comply with Assembly Bill 190.
