Submitting your 2021 EEO-1 Component 1 reports has changed, here’s what you need to know.

Over the past several years, we have enjoyed being able to support your EEO-1 Component 1 report filing. As of 2022, the Equal Employment Opportunity Commission (EEOC) has requested that PEOs have clients submit individual 2021 EEO-1 Component 1 reports themselves and each year after.  Thus, as a PEO, we will no longer be filing an aggregate EEO-1 Component 1 Report on your behalf to the EEOC.  ADP TotalSource will provide support, tools and assist with regulatory standards to ensure you can successfully generate, upload, and certify the EEO-1 report moving forward.

What is the EEO-1 Component 1 report?

The EEOC, a government body responsible for enforcing laws that prohibit employment and pay discrimination, requires employers to report data that details the pay and diversity of their employees.

The EEO-1 report collects data about the number of employees by job category and by sex and race or ethnicity. In November 2016, the EEOC revised the report for the reporting year 2017 to include summary pay data (W-2 earnings) and aggregate hours worked in addition to the number of employees by job category and by sex and race or ethnicity.

When can I file the EEO-1 Component 1?

The 2021 EEO-1 Component 1 data collection is tentatively scheduled to open on Tuesday, April 12th, 2022.

Who is required to file the EEO-1 Component 1 report?

The following companies are required to file the EEO-1 Component 1 Report:

·       Private employers with 100 or more employees.

·       Federal government prime contractors or first-tier subcontractors with 50 or more employees and a prime contractor or first-tier subcontract amounting to $50,000 or more.

How is ADP helping YOU with this new obligation?
We are preparing to support this requirement with enhancements to the EEO-1 report currently available in ADP Workforce Now®. These enhancements are targeted to be available prior to the opening of EEOC portal. Our service teams will continue to support you with any questions you may have in updating required EEO-1 data.

How can I prepare for changes?

Ensure that your employees have all the following information:

  • Gender
  • Ethnicity/Race
  • EEOC Job Classification
  • EEO Establishment

Keep a lookout for updated communications via Insight & Solutions and email. As a reminder, the EEO-1 reporting is mandatory. If an employer fails or refuses to file its EEO-1 component 1 report, the EEOC may compel an employer to file this form by obtaining an order from the US District Court. The penalties for failure by a federal contractor or subcontractor to comply may include termination of the federal government contract and debarment from future federal contracts.
