The Regulations
The regulations, which will be published in the Federal Register on May 23, 2016, increase the salary level from $23,660 to $47,476 per year, permit employers to include nondiscretionary bonuses, incentive pay and commissions to satisfy up to 10 percent of the new standard salary level, and provide for an automatic update to the salary every three years. No changes to the current duties tests were included in the final regulations. The effective date of the regulations is December 1, 2016.
The Department of Labor has released three technical guidance documents, designed to help private employers, non-profit employers, and institutions of higher education come into compliance with the new regulations. These guides along with additional resources, can be found in the following links:
