USCIS Announces New Form I-9 and Alternative Verification Procedure

U.S. Citizenship and Immigration Services (USCIS) announced a new version of Form I-9 (I-9) to verify the identity and employment authorization of employees and a new alternative procedure to the in-person physical document examination method that employers have followed as part of the I-9 process. The new I-9 can be used starting Aug. 1, 2023 and must be used starting Nov. 1, 2023.  

The alternative procedure may be used starting on Aug. 1, 2023 and does not expire, but can be cancelled or amended by the Department of Homeland Security. The alternative procedure is only available to employers enrolled in E-Verify.

The new I-9 and instructions will be available in ADP®

 electronic I-9 products by Nov. 1, 2023 and will be posted to the USCIS website by Aug. 1, 2023. 

To enroll in E-Verify with ADP TotalSource

·       Complete the E-Verify Client Setup Form [SN1] available in the TotalSource forms resource in your payroll system.

·       Email the completed form to SetupEVerify@adp.com

·       ADP TotalSource will begin the enrollment process. During your enrollment, you will receive an email from the E-Verify system with a Memorandum of Understanding (MOU) that you must sign. Once you receive the email, you have 24-hours to sign the MOU.

·       ADP TotalSource offers the ability to E-Verify either (a) new hires from E-Verify mandatory states only or (b) all new hires.

·       ADP TotalSource requires all employers to use E-Verify in the following states: Alabama, Arizona, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, and Utah.

·       If you would like to use the new alterative procedure for remote examination for a new hire outside of the listed states, then you must elect to E-Verify all new hires.
