Collection of Basic Employment Policies Acknowledgement

Reminder: ADP TotalSource clients must distribute the Basic Employment Policies (BEP) (or the “Welcome Statement” in the case of unionized employees) to each new hire and submit a copy of the employee’s signed acknowledgment (BEPA) within three days of hire.


ADP TotalSource® is always working to help your company mitigate risk and stay compliant with a myriad of employment regulations.  One way we do this is through the distribution of the Basic Employment Policies (BEP).  The BEP is a critical document designed to mitigate your company’s risk by including key legally required policies while providing employees with a baseline understanding of the PEO relationship. Securing the employee’s signature acknowledging receipt of the BEP may be a critical component of your company’s defense should the employee later file a claim against you.

Fee to be assessed for missing BEP acknowledgements; Legal Defense Benefit may be denied

Beginning with your first payroll invoice in September 2015, your company will be assessed a $10 monthly charge for every missing BEP or Welcome Statement acknowledgment and, going forward, for every acknowledgment not submitted timely to ADP TotalSource by you or electronically by your employees. 

Your failure to submit a signed acknowledgment for an employee may also result in ADP TotalSource’s denial of the Legal Defense Benefit if the employee later files an otherwise covered claim against your company.

To help make collection of these acknowledgements easy for your company, we offer the following submission options: 

1.     A  fully electronic solution (paperless new hire), which allows new employees to electronically acknowledge the BEP online; and

2.     A paper-based process to help you submit a copy of the signed BEPA to us at the time of hire. 

You can view a list of employees whose acknowledgments have not been submitted in the Alerts section on the My TotalSource® home page.  Additionally, you and your employees can utilize the Consents application on My TotalSource which enables your employees to provide their acknowledgement electronically after they have been hired.  This application also allows you to view which employees still have an outstanding acknowledgment.
