Maryland harassment survey due July 1 reminder

Maryland employers with 50 or more employees must submit a sexual-harassment-disclosure survey electronically to the Maryland Commission on Civil Rights (MCCR) on or before July 1, 2020. Covered employers must complete the survey again on or before July 1, 2022. The requirements were part of Senate Bill 1010, which was enacted in 2018.

Maryland requires consent before using facial recognition during interviews

Maryland has enacted legislation (House Bill 1202) that will prohibit employers from using facial recognition services during an interview unless the applicant consents. House Bill 1202 takes effect Oct. 1, 2020.

Maryland expands equal pay protections

Maryland has enacted legislation (House Bill 123 and House Bill 14) that requires employers to provide pay transparency to applicants, prohibits employers from seeking an applicant's pay history, and bars employers from taking adverse action against employees for inquiring about their own wages. Both laws take effect on Oct. 1, 2020.

Maryland bans hairstyle discrimination

Maryland has enacted legislation (House Bill 1444) that will expressly prohibit employers from discriminating against individuals because of hair texture and protective hairstyles. House Bill 1444 takes effect Oct. 1, 2020.

Maryland amends mini-WARN law

Maryland has enacted legislation (Senate Bill 780) that amends the Economic Stabilization Act (also known as Mini-WARN) to require Maryland employers with at least 50 employees to provide 60 days' written notice before initiating a reduction in operations. Senate Bill 780 takes effect Oct. 1, 2020.

Maryland restricts background checks

Maryland has enacted legislation (Senate Bill 839) that will prohibit covered employers from inquiring about applicants' criminal history prior to the first in-person interview. Senate Bill 839 took effect Feb. 29, 2020.

Maryland requires organ donation leave

Maryland has enacted legislation that will require certain employers to provide organ and bone marrow donation leave to eligible employees.

Maryland to Increase Minimum Wage

Maryland has enacted legislation (Senate Bill 280) that will increase the state’s minimum wage in several phases. 

Baltimore Enacts New Lactation Break, Room, and Policy Requirements

Baltimore has enacted new lactation accommodation requirements, including a requirement for covered employers to adopt a lactation room policy.

Maryland Enacts the Disclosing Sexual Harassment in the Workplace Act of 2018

On May 15, 2018, Maryland Governor Larry Hogan signed into law the Disclosing Sexual Harassment in the Workplace Act of 2018 (the “Act”), which prohibits contractual waivers of sexual harassment claims and imposes significant reporting requirements for certain Maryland employers as well.
