Massachusetts annual sexual harassment notice

In Massachusetts, the law requires employers to adopt a written policy against sexual harassment. The policy must include, for example, notice to employees that sexual harassment in the workplace is unlawful and that it is unlawful to retaliate against an employee for filing a complaint of sexual harassment. The policy should also assert the employer’s commitment to investigate any complaint of sexual harassment.

Massachusetts Health Insurance Responsibility Disclosure (HIRD)

It is almost time for the HIRD filing. Each year, Massachusetts state law requires employers to file a HIRD form that contains information about employer-sponsored benefits offerings.

Massachusetts delays paid family & medical leave program contributions

Massachusetts has enacted legislation (Senate Bill 2255) that will delay the implementation of contributions to the state’s paid family leave program and make other changes.

Massachusetts officially delays and amends paid family leave law

Massachusetts officially delayed the start of contributions under the Massachusetts Paid Family and Medical Leave Act (PFMLA) until October 1, 2019, and amended the law.  With the delay, the Massachusetts Department of Family and Medical Leave announced a number of changes.

Per Massachusetts law, commission only inside salespersons entitled to overtime and Sunday pay

Adhering to the “plain and ordinary” language of the state’s overtime statute and related regulations, the Massachusetts Supreme Judicial Court has held that inside sales employees paid on a 100-% commission basis are also entitled to pay for overtime hours worked and premium pay for work on Sundays. Sullivan v. Sleepy’s LLC, 2019 Mass. LEXIS 244 (Mass. May 8, 2019).

Massachusetts Releases Paid Family and Medical Leave Employer Guide, Workplace Poster, and Template Notices

Massachusetts has released a new guide for employers on the Massachusetts Paid Family and Medical Leave Act.  It has also issued a mandatory workplace poster, and template notices employers may use to fulfill the notice requirement to employees and 1099-MISC independent contractors. 

Update: Massachusetts Paid Family and Medical Leave FAQs Released

The newly created Department of Family and Medical Leave has launched a website that includes guidance for employers, including answers to frequently asked questions by employers and frequently asked questions by employees.

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Massachusetts EMAC Supplement Hardship Waiver Regulations

In response to the feedback taken during Listening Sessions, the Commonwealth of Massachusetts’ Department of Unemployment has released guidance outlining the scenarios in which they will consider hardship waiver requests for companies assessed a quarterly EMAC Tier II Supplement.
