New Jersey Approves New Minimum Wage

New Jersey has enacted legislation (Assembly Bill 15) that will raise the state’s minimum wage in several stages.

New Jersey Employers Must Provide Annual CEPA and Gender Inequity Notices to Employees

We would like to remind New Jersey clients of their obligation to annually distribute to their New Jersey employees the required CEPA and Gender Inequity notices. 

New Jersey Paid Sick Leave Act Reminder

As noted previously, New Jersey Governor Phil Murphy (D) has signed into law the New Jersey Paid Sick Leave Act (the “Act”), which will provide eligible employees with paid leave for their own medical needs, those of a family member, or other covered reasons. 

The New Jersey Department of Labor and Workforce Development has released on its website the required notice that must be posted and distributed to all New Jersey employees under the New Jersey Paid Sick Leave Act. 

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

New Jersey Department of Labor Release Proposed Paid Sick Leave Regulations

Proposed regulations on the New Jersey Paid Sick Leave Act (NJPSLA) were released by the New Jersey Department of Labor and Workforce Development (NJDOL) on September 18, 2018. The NJPSLA will go into effect on October 29, 2018. The proposed Regulations address some questions created by the Act, but leave others unanswered. Written comments on the proposed Regulations must be submitted to the NJDOL by December 14, 2018.

All applicants and employees working in any New Jersey Department of Human Services (“DHS”) funded, licensed or regulated program serving adults with developmental disabilities are subject to mandatory drug testing.

New Jersey expanded its civil rights protections to include breastfeeding, expressing milk, and related medical conditions. Employers must also provide reasonable accommodations for breastfeeding women, including reasonable break time and a suitable location to express milk in private.
