Top FAQs on Criminal History Inquiries, Ban the Box and Fair Chance Laws

Many states and local jurisdictions have enacted laws that restrict employers from asking an applicant about their criminal background on application forms. Some go even further, restricting these types of questions until after the employer makes a conditional job offer and/or requiring employers to take certain steps before considering an individual’s criminal history. These restrictions are often referred to as "ban the box" or “fair chance” laws.

Last steps for your 2023 ACA filing!

If you are an Applicable Large Employer and approved ACA reporting by Feb. 21, 2024, transmission of your 2023 ACA filings is complete! ACA Reporting is filed under your unique FEIN. After transmission to the IRS, it is possible for your filing to come back with a status of “Accepted with Errors”. In most cases, these can be resolved by transmitting a correction to the IRS.

The IRS will require all forms with errors to be addressed before April 1, 2024. If not resolved, or resolved late, you may be assessed penalties from the IRS. The most common error found on Form 1095-C is 1095C-010-01 – an employee name and Social Security Number mismatch.

This valuable review period ensures that your certificates are accurate, and removes any unnecessary documents from your account before they are automatically renewed.

On March 1, you can go through your certificates and make any changes or delete the ones that are no longer valid for your business. This is the perfect opportunity to update and fix any details in your active certificates before they automatically renew in May.

OSHA compliance reminder: Certain employers must electronically submit their 2023 OSHA Form 300A (Summary of work-related injuries and illnesses) by March 2, 2024.

Last month we published an article reminding you to post your OSHA Form 300A in the workplace from Feb. 1 through April 30, 2024. Some employers are also required to electronically submit the information from their 2023 OSHA Form 300A via the OSHA Injury Tracking Application (ITA). This year OSHA provided a new tool in ITA Coverage Application to help employers determine if they are covered by the regulation.

The New Independent Contractor Test & Key Points to Know

The U.S. Department of Labor (DOL) has published a final rule that will change the test for determining whether a worker is an employee or independent contractor under the Fair Labor Standards Act (FLSA). The final rule takes effect March 11, 2024. Here are some key points to know about the new test.

Who is filing your 2023 ACA Reporting?

If you are an Applicable Large Employer (ALE)*, your business could face significant IRS assessments if your Affordable Care Act (ACA) reporting forms 1095-C for the 2023 reporting year are not timely distributed to your full-time employees.  Please review and acknowledge your filing in the ACA Reporting Tool (ART) by Jan.  31, 2024, so that we can timely distribute the forms to your full-time employees.
