Seattle Ends Subminimum Wage

Washington state and Seattle both have separate minimum wages and processes for obtaining an exemption from their minimum wages. Under Seattle's minimum wage provision, an employer was permitted to apply for exemption from the city's minimum wage only after receiving an exemption from the state.
Recently, the Seattle City Council unanimously passed a bill (CB 119220) eliminating the subminimum wage for workers within the city with a disability, as well as other categories of workers exempted under state law from the state minimum wage. The Seattle Municipal Code now provides that the Office of Labor Standards “shall not grant special certificates authorizing employers to pay less than the City of Seattle minimum wage.”

Action Required: Employers with employees in Seattle must ensure that all non-exempt employees, including individuals with disabilities and other individuals previously exempted from the minimum wage, are paid at least minimum wage.
