USCIS Policy Change Retroactively Shortens Certain TPS-Based EAD Automatic Extensions

U.S. Department of Labor Proposes New Independent Contractor Test

The U.S. Department of Labor (DOL) has proposed changes to the test for determining whether workers are employees or independent contractors under the Fair Labor Standards Act (FLSA).   In addition, the Department proposes to apply this analysis to the Family and Medical Leave Act (FMLA) and Migrant and Seasonal Agricultural Worker Protection Act (MSPA).

DHS Announces Termination of TPS for Yemen

The Department of Homeland Security (DHS) announced that it will not extend the current Yemen Temporary Protected Status (TPS) designation beyond March 3, 2026.  However, impacted TPS beneficiaries will be granted a 60-day transition period through May 4, 2026 and will remain work-authorized throughout the transition period.

TPS Updates for Ethiopia, South Sudan, Burma, Syria, Somalia and Haiti (Updated)

The Department of Homeland Security (DHS) announced termination of Temporary Protected Status (TPS) for six countries. Courts have blocked termination for these countries.

For TPS beneficiaries from EthiopiaSouth SudanBurmaSyriaSomalia and Haiti. DHS directs that when completing the Expiration Date fields on Form I-9, input “as per court order” in Section 1 and a specific date based on the applicable U.S. Citizenship and Immigration Services (USCIS) announcement in Section 2 along with a note in the additional information box. Employers may also download the applicable Alert and TPS webpages and attach them to Form I-9.

Labor Board Officially Replaces Joint-Employer Test

Court Blocks Termination of Temporary Protected Status for Haiti

 A federal district court has blocked the Department of Homeland Security’s (DHS) decision to terminate Temporary Protected Status (TPS) for Haiti pending further court action. TPS for Haiti would have expired effective Feb.  3, 2026.  DHS has provided guidance on how to update Form I-9 in light of the court’s decision.

Employees in Puerto Rico Entitled to Special Leave Due to Influenza Outbreak

On Jan.  27, 2026, the governor of Puerto Rico issued Executive Order 2026-005 (EO 2026-006), declaring a public health emergency and implementing an additional 5-day paid sick leave requirement for non-exempt employees due to an influenza outbreak on the Island.

Under 2026-005, non-exempt employees who have been diagnosed with or are suspected of having influenza are only entitled to the additional five paid working days of leave once accrued paid sick leave and any other paid leave entitlement (e.g. vacation) has been exhausted.

Appeals Court Reinstates TPS Termination for Honduras, Nepal and Nicaragua

:  The U.S. Court of Appeals for the Ninth Circuit has reversed a lower district court’s order vacating the Department of Homeland Security’s (DHS) termination of Temporary Protected Status (TPS) for Honduras, Nepal, and Nicaragua.   The district court’s order is no longer in effect while the appeal proceeds.
