Hawaii expands nondiscrimination law

Hawaii has enacted legislation (House Bill 710) that prohibits employers from discriminating against individuals based on their reproductive health decisions. House Bill 710 is effective immediately.

Background:

Hawaii prohibits all employers from discriminating against individuals because of their race, sex including gender identity or expression, sexual orientation, age, religion, color, ancestry, disability, marital status, arrest and court record, or domestic or sexual violence victim status.

House Bill 710:

House Bill 710 added "reproductive health decision" to the state's list of protected characteristics. Reproductive health decision means the use or attempted use of any legal drug, device, or medical service intended to prevent or terminate a pregnancy, or the use or attempted use of any assisted reproductive technology.

Compliance Recommendations:

Employers should update their policies and procedures and train supervisors to comply with House Bill 710. Please contact your dedicated service professional with any questions.
