New York City Releases Enforcement Guidance on Race Discrimination on Basis of Hair

Legal enforcement guidance on race discrimination on the basis of hair from the New York City Commission on Human Rights affirms that employer policies on appearance and grooming that ban, limit, or otherwise restrict natural hair or hairstyles may be unlawful under the New York City Human Rights Law (NYCHRL). 

New York City Prohibits Discrimination Based on Sexual and Reproductive Health Decisions

The list of protected classes under the New York City Human Rights Law has expanded to include “sexual and other reproductive health decisions”. 

New York City Enacts New Lactation Room, Policy Requirements

New York City has enacted new lactation accommodation requirements, including a requirement for covered employers to adopt a lactation room policy.

New York State Expressly Prohibits Discrimination Based on Gender Identity or Expression

New York state has enacted legislation (Assembly Bill 747) that expressly prohibits employers with four or more employees from discriminating against individuals because of their gender identity or expression.  Assembly Bill 747 takes effect on February 24, 2019. 

New York State Extends Wage Deduction Amendment Rules

On December 7, 2018, New York Governor Cuomo signed into law bill A10615 immediately extending for eight years the 2012 amendments to New York Labor Law 193 that permit employers to make deductions from wages for items such as overpayments and advances against wages, subject to certain procedures governed by Labor Department regulations.

New York Amends its Laws Regarding Organ and Tissue Donation

New York’s laws regarding organ and tissue donation have been amended. The law prohibits insurers from discriminating in life, accident, and health insurance based on a person’s status as a living organ or tissue donor. In addition, the law authorizes the use of paid family leave benefits for organ or tissue donation procedures.

New Suffolk County, NY, Bill Bans Inquiry into Salary History

Joining New York City, Albany County, and Westchester County, Suffolk County has become the latest jurisdiction in New York to pass a bill that prevents employers from inquiring into the salary and benefits history of job applicants.

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Westchester County Requires Sick Leave For Employees

Westchester County in New York has enacted an ordinance that will require employers to provide sick leave to employees who work in the county.

New York Law Requires Human Trafficking Informational Cards in Hotels, Considering Employee Training

All hotels in New York with at least five rooms will be required to post human trafficking “informational cards” throughout each hotel’s premises.
