Annual reminder: Florida E-Verify certification

ADP TotalSource® would like to gently remind you that your company holds the responsibility for compliance with F.S. Section 448.095 regarding employment verification and annual certification, which includes the mandatory use of E-Verify. Please note that ADP TotalSource® is unable to certify compliance with F.S. Section 448.095 to the Florida Department of Revenue (DOR) on behalf of your company. We kindly ask that all ADP TotalSource® clients with employees working in Florida ensure their enrollment in E-Verify.

Note: The law generally applies to employers employing 25 or more employees but is silent on how employers in a co-employment relationship with a Professional Employer Organizations (PEO) should determine employer coverage (e.g. should coverage be determined based on the number of employees employed by a PEO client or by the number of employees employed by the PEO with all clients?).  In consideration of this ambiguity and the potential consequences of non-compliance, we kindly ask that all clients with employees working in Florida (regardless of the number of employees each client has) certify their compliance.

Certifying compliance

You should certify compliance online or by mailing the PDF form (see address on last page) below:

The Employer E-Verify Certification form from the State of Florida must include the Federal Employer Identification Number (FEIN) of the ADP TotalSource® entity which files your Florida Reemployment Tax Return or Report (see below).


Next steps

·       Determine the FEIN of the ADP TotalSource® entity which files your Florida returns using the instructions below.

·       Complete the FL DOR E-Verify Certification each calendar year.

 

Where to find the ADP TotalSource FEIN

There are two locations where you can find the FEIN for the ADP TotalSource entity that files your returns and reports with the DOR.  

Payroll Reports Wage and Tax reporting

1.     Log onto your ADP TotalSource platform.

2.     Navigate to Reports & Analytics > iReports > Payroll & Quarterly/Annual Reports > Quarterly/Annual Reports.

3.     Find and download any of the Wage and Tax reports (also displayed as W&T).

4.     The ADP TotalSource® FEIN can be found at the bottom of any of the report pages with data, listed as Federal ID.

 

Form 8973 Certified Professional Employer Organization/Customer Reporting Agreement

1.     Log onto your ADP TotalSource platform.

2.     Navigate to Resources > Company Information > Contracts.

3.     Find and download the Form 8973.

Note: If your Form 8973 is not available, use the Payroll Reports option above to find the ADP TotalSource FEIN.

4.     The ADP TotalSource FEIN can be found on Page 1, Part 3: CPEO Information and is listed as CPEO’s employer identification number (EIN) or on Page 3 listed as CPEO’s EIN.
