New York Sets Conditions for Payment of Wages by Direct Deposit or Debit Pay Card

The New York State Department of Labor adopted a final regulation that sets the conditions by which New York employers can pay wages by direct deposit or payroll debit card. The regulation, which goes into effect March 7, 2017, imposes significant obligations on employers who wish to offer the option of wage payment through these means.

Oregon Manufacturing Employers Must Double Count Daily and Weekly Overtime

The Oregon Bureau of Labor and Industries announced a significant reinterpretation of the interplay between the state’s daily and weekly overtime laws. According to BOLI, manufacturing employers must fully and separately provide overtime pay under both statutes instead of paying the greater of the two amounts.

Executive Order Bars Individuals from Seven Countries

The “Protecting the Nation from Foreign Terrorist Entry into the United States” Executive Order, issued by President Donald Trump on January 27, 2017, bars from entry into the United States certain specified classes of individuals from Iraq, Iran, Libya, Somalia, Sudan, Syria and Yemen. It also requires in-person interviews of any individual from any country, who seeks a visa, prior to the issuance of the visa.

OSHA Issues Walking-Working Surfaces Rule

The Occupational Safety and Health Administration’s (OSHA) final rule on Walking-Working Surfaces aims to reduce work-related injuries resulting from slips, trips, and falls. It incorporates advances in technology, industry best practices, and national consensus standards to provide effective and cost-efficient worker protection. The final rule provides employers greater flexibility in choosing a fall protection system to protect workers. It revised and added new provisions that address rope descent systems, ladder safety, and worker training. OSHA also aligned, as much as possible, the general industry fall protection requirements with those for construction to ease compliance for employers who work in both sectors.

Challenge to Arizona Minimum and Paid Sick Leave Filed in State Court

A lawsuit has been filed in Arizona state court seeking to stop the newly approved minimum wage hike and paid sick leave ballot initiative from taking effect. According to the Arizona Chamber of Commerce, the proposal's lack of a state revenue generator and its inclusion of multiple subjects violate the state's constitution.

Reminder - New York Issues Final Minimum Wage Regulations Impacting Minimum Salary for Exempt Employees - Effective 12/31/16

As we reported last week, the New York State Department of Labor has adopted regulations implementing increases to the state minimum wage, identified required salary levels for exclusions from overtime pay for executive and administrative employees, and issued Frequently Asked Questions for employers.
