New Jersey expands wage statement requirements

New Jersey has enacted legislation (Senate Bill 1791) that will require employers to provide employees with an earnings statement each pay period. Senate Bill 1791 takes effect May 19, 2020.


Background:

Currently, New Jersey requires employers to provide each employee with a statement of all deductions made from that employee's wages for each pay period in which the deductions occur.


SB 1791:

SB 1791 requires employers with 10 or more employees to provide their employees with a statement of earnings for each pay period. Wage statements must include any deductions made, as well as:

  • Gross wages;
  • Net wages;
  • Rate of pay; and
  • The number of hours worked by the employee during the pay period, if it is relevant to the wage calculation.

The wage statement may be provided to an employee electronically unless the employee requests a paper version.


Compliance Recommendations:

New Jersey employers should ensure compliance with Senate Bill 1791 by May 19, 2020. Please contact your dedicated service professional with any questions.
