U.S. Citizenship and Immigration Services (USCIS) has updated the Form I-9 (I-9) to extend the expiration date from July 31, 2026 to May 31, 2027.
The Details
By way of background, the I-9 is used to verify a new hire's identity and work authorization. All employers must ensure that an I-9 is properly completed for each employee at the time of hire. The expiration date of the form can be found in the upper right-hand corner.
New Expiration Date
Employers must use the I-9 that shows the edition date of August 1, 2023 in the lower left corner. This edition of the form may now have an expiration date of either July 31, 2026 or May 31, 2027 in the upper right-hand corner.
Either version of the form may be used until its respective expiration date. However, USCIS is encouraging employers that use electronic I-9 systems to update to the version with the May 31, 2027 expiration date as soon as possible in order to ensure the new form is in use by July 31, 2026.
Next Steps
· Ensure you are using the I-9 with an edition date of August 1, 2023 in the lower left corner.
· Begin using the I-9 with an expiration date of May 31, 2027 as soon as possible and no later than July 31, 2026.
· The ADP electronic I-9 product will be updated by July 31, 2026.
