The Details
The Department of Homeland Security (DHS) recently announced the termination of the 2021 Temporary Protected Status (TPS) designation for Venezuela. Originally, the 2021 designation for Venezuela was set to expire on Sept. 10, 2025. DHS has indicated that Venezuela TPS beneficiaries under the 2021 designation continue to be employment-authorized during a 60-day transition period through Nov. 7, 2025.
As proof of continued employment authorization through Nov. 7, 2025, impacted TPS beneficiaries can show their employment authorization documents that have the notation A-12 or C-19 under Category and a “Card Expires” dates of Sept. 9, 2022,
March 10, 2024, and Sept. 10, 2025. DHS does not provide guidance on whether employers should update Form I-9 to reflect the Nov. 7, 2025 effective date.
Venezuela TPS beneficiaries under the 2021 designation will need to acquire alternative work authorization by Nov. 7, 2025, to continue to work uninterrupted.
Note that a separate Venezuela TPS re-designation in 2023, with an expiration of April 2, 2025, was cancelled pursuant to DHS’ notice terminating this 2023 designation on Feb. 5, 2025.
Litigation over Venezuela TPS designations is ongoing and ADP will continue to monitor the situation and provide updates.
