New York City limits use of automated tools in employment decisions

New York City has enacted legislation (Int. No. 1894-A), that amends the New York City Human Rights Law and regulates the use of automated tools in certain employment decisions. The law takes effect on Jan. 1, 2023.

New York City enacts salary transparency law

The New York City Council has enacted a law (Int. No. 1208-B) which requires New York City employers to include the minimum and maximum starting salary for advertised jobs, promotions or transfer opportunities. The law takes effect on May 15, 2022.

Updated January 2022: New York adds temporary winter mask mandate

Governor Kathy Hochul of New York had announced a temporary mask mandate for businesses and venues, unless they implemented a vaccine requirement. The mandate was scheduled to be in effect from Dec. 13, 2021 until Jan. 15, 2022, unless extended.

New Mexico, Santa Fe announces increase to minimum wage for 2022

The City of Santa Fe, New Mexico has announced that effective March 1, 2022 the living wage rate in Santa Fe will increase from $12.32 to $12.95 per hour. All employers required to have a business license or registration from the City of Santa Fe must pay at least the living wage rate to employees for all hours worked within the Santa Fe city limits. All employees, including temporary and part-time workers, must be paid this rate.

New Jersey limits employer vehicle tracking

New Jersey has enacted legislation (Assembly Bill 3950), which requires an employer to notify its employees before using a vehicle tracking device. Assembly Bill 3950 takes effect on April 19, 2022.

Minnesota OSHA suspends enforcement of vaccination and testing rule

Minnesota OSHA (MNOSHA) has announced that it will suspend enforcement of the state’s emergency temporary standard (ETS), which requires that employers with 100 or more employees ensure that employees either be vaccinated against COVID-19 or produce a weekly negative test.

California - Los Angeles County requires employers to provide masks to employees

The Los Angeles County Department of Public Health (LACDPH) has issued an order requiring all employers to provide masks to employees who work indoors and in close contact with other works or the public. Employers must provide masks as soon as possible but no later than Jan. 17, 2022.

Reminder: Colorado’s paid sick leave law now applies to smaller employers

Effective Jan. 1, 2022, Colorado (CO) requires employers with 15 or fewer employees to provide paid sick leave to employees. Larger employers were already subject to the requirement.

California releases further guidance on pay of garment workers

California extends mask requirement

The California Department of Public Health (CDPH) has extended the requirement to wear face masks indoors until at least Feb. 15, 2022, regardless of COVID-19 vaccination status. Before the extension, the mask requirement was scheduled to end on Jan. 15, 2022.

California Gender Self-ID rules at the State and Local level

Background:

California's Fair Employment and Housing Act (FEHA) prohibits harassment and discrimination because of sex, gender, gender identity, gender expression and certain other characteristics. The discrimination provisions cover employers with five or more employees, but the harassment provisions cover all employers.

Preferred Gender, Pronoun, and Name:

In California, employers must generally abide by an employee's request to be identified with a preferred gender, name, and/or pronoun, including gender-neutral pronouns, according to state regulations. However, if it is necessary to meet a legally mandated obligation, such as a W-2 Form, employers may use an employee's gender or legal name as indicated in a government-issued identification document.

Employer Inquiries:

California employers are generally prohibited from making inquiries that directly or indirectly identify an individual on the basis sex, gender, gender identity, or gender expression. Employers are also generally prohibited from inquiring about or requiring documentation or proof of an individual's sex, gender, gender identity, or gender expression as a condition of employment. However, for the purposes of complying with recordkeeping requirements for applicant records  under the state's nondiscrimination law, an employer may request an applicant to provide this information but only if it is on a voluntary basis.

Note: The law doesn’t prohibit an employer and employee from communicating about the employee's sex, gender, gender identity, or gender expression when the employee initiates a discussion with the employer regarding the employee's working conditions.
