New York State Issues Final Guidance Regarding Combating Sexual Harassment in the Workplace

The State of New York has issued final guidance on combating sexual harassment in the workplace. This includes updated guidance on the mandatory sexual harassment prevention policies and annual employee training applicable to employers in New York beginning October 9, 2018.

New York City ‘Cooperative Dialogue’ Mandate Over Accommodation Requests

New York City Enacts Law Allowing Requests for Temporary Schedule Changes

New York City Limits Fast Food and Retail Employers’ Scheduling Flexibility

The New York City Council passed the “Fair Workplace” legislative package, which regulates scheduling for fast food and retail employees.  Comprised of multiple separate bills, the legislation acts mostly to restrict fast food and retail employers’ ability to create and modify employee schedules. It also imposes penalties for employer violations, and requires fast food employers to pay specified premiums for scheduling variations that are made outside a delineated time frame.

Minimum Wage Update for Missouri and Minimum Salary Threshold Update for Alaska, California, Colorado, Maine and New York

In addition to the states identified in the December 14, 2017, Insights & Solution newsletter, Missouri will see an increase to its minimum wage come January 1, 2018. Alaska, California, Colorado, New York and Maine will also see increases to the minimum salary threshold for employee exemptions.

Amendment Regulation Governing Payment of Wages to Home Health Aides Issued in New York

The New York State Department of Labor recently amended its Minimum Wage Order for Miscellaneous Industries and Occupations to state that bona fide meal periods and sleep times may be excluded from hours worked by home care aides who work a shift of 24 hours or more consistent with federal Fair Labor Standards Act regulations.

New York City Issues Guidance on Upcoming Salary Inquiry Prohibitions

The New York City Commission on Human Rights recently released an Employer Fact Sheet and a Job Applicant Fact Sheet to assist employers and employees with understanding the law prohibiting employers from inquiring or relying on a job applicant’s salary history when making hiring decisions.  The new law takes effect on October 31, 2017.
