IRS 2019 Form W-4 Represents Major Changes to Payroll

On June 6, 2018, the Internal Revenue Service (IRS) released a draft Form W-4, Employee’s Withholding Allowance Certificate, for 2019. Several changes are fundamental in nature, potentially requiring significant reprogramming of payroll systems. State and local tax authorities are also expected to respond with similar changes. 

Minimum Wage Update Effective July 1, 2018 for Various Jurisdictions

Federal Compliance Update
The following states/localities have increased their minimum wage rates. You can view the document here. If applicable, you must increase the pay rate for non-exempt employees to meet the new minimum wage on or before July 1, 2018, and, if needed, order a new poster. The minimum wage rate is based on the employee’s work location. 

OSHA Only Requiring Electronic Submission of 300A Forms and Clarifies that Employers in State Plans Must Submit Injury & Illness Data

Recently, the Occupational Safety and Health Administration (“OSHA”) made clear that it will no longer collect or require employers with 250 or more employees per establishment (per physical location of a single business) to submit the 300 Log or the 301 Forms (Illness and Injury Recordkeeping forms). OSHA will require all employers, including those on state plans (if not on the federal plan) and covered by the regulation, to only submit the 2017 Form 300A by July 1, 2018. Beginning in 2019 and every year thereafter, the 300A Forms must be submitted by March 2.

United States Department of Labor Issues Guidance on Travel Time, Breaks, and Overtime Pay in Higher Institutions

On April 12, 2018, the United States Department of Labor (“DOL”) issued two opinion letters. These letters provide guidance on how employees without "normal working hours" should be compensated for travel time involving an overnight stay and whether rest breaks provided as a “reasonable accommodation” are compensable. The DOL also issued a fact sheet detailing when teachers, coaches, and other professionals who work at higher education institutions should be paid overtime.
