The Department of Labor (DOL) has published a final rule revising its tipped employee regulations. The final rule was scheduled to take effect March 1, 2021, but the DOL has since pushed back the effective date to April 30, 2021.

On Thursday, March 11^th, President Biden signed The American Rescue Plan Act of 2021 (“ARPA”) into law. Amongst broader COVID-19 and Economic relief, ARPA provides for a 100 percent federally-financed subsidy of COBRA insurance premiums that is available to certain eligible individuals during the period beginning on April 1, 2021 and ending on September 30, 2021.   

Over the years, employees have filed complaints alleging their employers violated existing nondiscrimination laws by prohibiting them from wearing certain hairstyles. Courts have generally been split on whether restricting certain hairstyles violates laws prohibiting racial discrimination. In response to these cases, several jurisdictions have passed laws that expressly prohibit hairstyle discrimination.
