OSHA compliance reminder: Certain employers must electronically submit their 2024 OSHA Form 300A (Summary of work-related injuries and illnesses) by March 2, 2025

Last month we published an article reminding you to post your OSHA Form 300A in the workplace from Feb.  1 through April 30, 2025. Some employers are also required to electronically submit the information from their 2023 OSHA Form 300A via the OSHA Injury Tracking Application (ITA). This year OSHA provided a new tool in ITA Coverage Application to help employers determine if they are covered by the regulation. OSHA also updated the ITA for enhance data security.

Electronic Employee Termination Letters

To support our sustainability efforts and reduce paper usage, we will begin sending employee termination letters electronically effective 2/20/25. This change aligns with our commitment to reducing our environmental impact while maintaining efficient and secure communication. Please ensure employees’ contact information are always up to date in the system. In the event an email address is not listed, the letter will be sent through USPS to the employee's home address.

Executive Order 11246 Revoked – Impact on Federal Contractors

On Jan. 21, 2025, President Donald Trump issued an executive order (“new EO”) titled “Ending Illegal Discrimination and Restoring Merit-Based Opportunity”.  For federal contractors, the new EO eliminates federal contractor affirmative action plan obligations regarding race and gender (as had been required by EO 11246) and enforcement activity by the OFCCP regarding race or gender affirmative action plans.

Ohio Enacts Pay Statement Law

On Jan. 8, 2025, the Governor of Ohio signed into law HB 106 which requires that every employer provide each of its employees with a written or electronic statement or access to a statement of the employee's earnings and deductions for each pay period on the employer's regular paydays.

Current Ohio law does not require that employers provide a pay statement to its employees.

New York Enacts Fashion Workers Act

New York has enacted legislation (Senate Bill 9382), also known as the Fashion Workers Act (the Act), which adds workplace protections related to working with models in New York. The Act takes effect on June 19, 2025.

New York adds mental health protections to State Workers' Compensation Law

New York has enacted legislation (Assembly Bill 5745), which amends the New York State Workers' Compensation Law, allowing all workers to file for workers' compensation for mental injury due to extraordinary work-related stress incurred at work. Assembly Bill 5745 took effect on Jan.  1, 2025.

New Jersey Provides Guidance On AI Use In Employment Tools

Illinois To Phase Out Subminimum Wage For Employees With Disabilities

Illinois has enacted legislation that will phase out employers' ability to pay a subminimum wage for employees with disabilities in the state. The goal of the new law is to eliminate the use of the subminimum wage by Dec. 31, 2029.
