Duluth, Minnesota amends its paid sick leave ordinance

On July 19, 2021, Duluth Mayor Emily Larson signed File No. 21-23-0, which expands the reasons that leave may be used under Duluth’s Earned Sick and Safe Time (ESST) ordinance and expands on the notice requirement. The amendment to the ESST are effective Aug. 19, 2021.

Non-Minneapolis employers must comply with Minneapolis paid sick leave law

Minneapolis’ Sick and Safe Ordinance extends to any employee who performs at least 80 hours of work per benefit year in the City of Minneapolis, even if their employer is not located within the city’s limits, the Minnesota Court of Appeals has held. Minnesota Chamber of Commerce v. Minneapolis, No. A18-0771 (Apr. 29, 2019). This significant ruling stretches Minneapolis-imposed requirements to non-Minneapolis employers, including — in some instances — requiring them to provide paid time off to their employees.

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Duluth, Minnesota Enacts Paid Sick Leave

On May 29, 2018, the Duluth City Council passed an Earned Sick and Safe Time ordinance (Ordinance No. 10571). This ordinance amended the Duluth City Code by adding a new Chapter 29E entitled Earned Sick and Safe Time. The ordinance will provide for paid Sick Leave and related leave beginning in the year 2020.

Discharging Employees for Refusing to Share Tips is Prohibited in Minnesota
