New Jersey adds employment protections for recreational marijuana users

New Jersey Governor Phil Murphy has signed Assembly Bill 21, also known as the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, or "the Act." While the Act is effective immediately, the employment-related protections for recreational marijuana users do not become operative until initial rules and regulations are adopted.

Connecticut makes clear hairstyle discrimination is prohibited

Connecticut has enacted legislation (House Bill 6515) that makes clear that employers are prohibited from discriminating against applicants and employees because of their hair texture and protective hairstyles. House Bill 6515 is effective immediately.

California Supreme Court: Employers are barred from rounding time for meal periods

California requires employers to provide COVID-19 supplemental leave

California has enacted legislation (Senate Bill 95) that requires employers with more than 25 employees to provide COVID-19 supplemental paid sick leave to employees. The leave requirement applies retroactively to January 1, 2021 and will remain in effect through September 30, 2021.

California adopts new COVID-19 prevention requirements including Paid Leave Requirements

As we previously reported the CA Department of Industrial Relations (DIR) has adopted emergency rules related to protecting workers from COVID-19, including a requirement for employers to adopt a written prevention program which must include processes to exclude employees from work under certain circumstances and provide the employee with paid leave.

California - Santa Rosa reinstates paid sick leave requirement for COVID-19

The city of Santa Rosa (CA) has approved an emergency ordinance that temporarily reinstates a requirement for employers to provide paid sick leave to employees for reasons related to COVID-19. This leave requirement is in effect from February 2, 2021 through March 31, 2021.

New York enacts COVID-19 leave and job protection

In March 2020, the State of New York enacted legislation (Senate Bill 8091) that provides paid or unpaid leave to employees subject to a quarantine or isolation order as a result of COVID-19. On February 2021, the state provided situational guidance for employees subject to multiple quarantine or isolation orders, for when an employee tests positive following their quarantine, and for when an employer mandates that an employee stay home due to potential exposure.

Iowa Permits Employers to Provide Employee Wage Statements by Electronic Means

Previously, employers were required to mail wage statements, provide them at the place of employment, or provide employees with the means to view and print an electronic wage statement at the workplace. Per House Bill 2240, employers are now allowed to provide wage statements to employees via secure electronic transmission or other secure electronic means.

If the employee is unable to receive his or her wage statement electronically, the employee must notify the employer in writing at least one pay period in advance, and the employer must:
  • Send the statement to the employee by mail;
  • Provide the statement to the employee at the employee’s normal place of business during normal employment hours; or
  • Provide the employee access to view the employee earnings statement electronically and provide the employee free and unrestricted access to a printer to print the statement.

Effective: July 1, 2018
