New Jersey gender inequity annual notice reminder

New Jersey law requires New Jersey employers with 50 or more employees (determined by counting all employees regardless of whether those employees work in New Jersey) to “conspicuously post” and distribute a notification stating employees’ rights to be free from gender inequity or bias in pay, compensation, benefits or other terms or conditions. This requirement complies with the New Jersey Law Against Discrimination, Title VII of the Civil Rights Act of 1964 and the Equal Pay Act of 1963.

Montana to increase minimum wage

Montana’s minimum wage will increase to $8.65 per hour on January 1, 2020. Apart from a few very narrow exceptions, all non-exempt employees must be paid at least $8.65 per hour.

Massachusetts annual sexual harassment notice

In Massachusetts, the law requires employers to adopt a written policy against sexual harassment. The policy must include, for example, notice to employees that sexual harassment in the workplace is unlawful and that it is unlawful to retaliate against an employee for filing a complaint of sexual harassment. The policy should also assert the employer’s commitment to investigate any complaint of sexual harassment.

Maine annual sexual harassment notice

Maine requires employers to annually provide their employees with notice of the employer’s sexual harassment policy.  The employer’s policy must contain, for example, the definition of harassment (with examples), the employer’s internal complaint mechanism, the Maine Human Rights Commission’s complaint process, and an anti-retaliation statement.

Dallas and San Antonio require paid sick leave

The cities of Dallas and San Antonio, Texas enacted ordinances that would require employers to provide paid sick leave to covered employees. Update: On Nov. 22, a Texas judge granted a temporary injunction preventing San Antonio’s sick leave ordinance from going into effect on Dec. 1. Business groups argue that the ordinance is unconstitutional and preempted by the Texas Minimum Wage Act. A trial date has not yet been set, but we will keep you updated on the status of the ordinance as developments unfold.

Pennsylvania enacts Construction Industry Employee Verification Act

Ohio increases minimum wage for 2020

California: state and local minimum wage changes for 2022

The minimum wage in California and in many local jurisdictions in the state will increase on January 1, 2022.

State Minimum Wage for 2022:

Effective January 1, 2022, the state’s minimum wage will increase to $14 per hour for employers with 25 or fewer employees. For employers with 26 or more employees, the state’s minimum wage will increase to $15 per hour.

Note: The change in the state’s minimum wage also impacts the minimum salary requirements for certain state exemptions from overtime. For the administrative, professional, and executive exemptions from overtime, employers with 26 or more employees must pay a salary of at least $1,200 per week beginning January 1, 2022. Employers with fewer than 26 employees must pay a minimum salary of at least $1,120 to these exempt employees.

Many cities in California that set their own minimum wages will increase them on January 1, 2022. The following chart includes many of these local jurisdictions.

This isn’t an exhaustive list. There may be additional local jurisdictions in the state that have scheduled increases for January 1. Check your local laws to confirm compliance.

Multiple Rates:

If an employee is covered by both the state and a local minimum wage, you should generally comply with the rate most generous to the employee.

Notice Requirements:

Employers should ensure that they display up-to-date state and local minimum wage notices. Employers may also be required to furnish a notice to employees. For instance, Oakland requires employers to notify employees of the change in the minimum wage and post an updated notice by December 15, 2021. Many of these local jurisdictions require the notices be in multiple languages. Check your local rules for details.

More 2022 Increases Coming:

Some jurisdictions schedule their changes at another point during the year. For example, several other cities in California will increase their minimum wages on July 1, 2022.
