Maine Amends Tip Pooling Rules

Maine has enacted legislation that will allow employees who don’t customarily and regularly receive tips to participate in tip pooling, provided the employer pays the full minimum wage and doesn’t use the tip credit. The change will take effect Oct. 25, 2023.

Illinois Requires Certain Employers to Offer Organ Donation Leave

Illinois has enacted legislation that will require employers with 51 or more employees to provide paid organ donation leave to employees. The law (House Bill 3516) takes effect Jan. 1, 2024.

Colorado – City of Edgewater Adopts Minimum Wage

The Edgewater, Colorado City Council has adopted Ordinance 2023-07, which establishes a local minimum wage. The new ordinance applies to employers with one or more "covered" employees, which are individuals performing, or expected to perform, four or more hours of work for an employer in any given week in Edgewater.

Alaska Updates Regulations on Board and Lodging Deductions

The Alaska Department of Labor and Workforce Development (LWD) has issued updated regulations detailing how employers may deduct the reasonable cost of board and lodging for employees from the state minimum wage. These regulations are effective July 28, 2023.

Colorado Expands Nondiscrimination Law

Colorado has enacted legislation (Senate Bill 23-172), which prohibits discrimination based on marital status, redefines harassment under state law, clarifies the protections for individuals with disabilities, and extends recordkeeping requirements. The changes take effect Aug. 7, 2023.

Georgia Amends Rules for Time Off for Voting

Georgia has enacted legislation (Senate Bill 129) that amends the rules governing an employee’s entitlement to time off to vote in elections. The changes take effect July 1, 2023.

Hawaii to Require that Job Listings Disclose Pay Information

Hawaii has enacted legislation (Senate Bill 1057), which requires employers with 50 or more employees to disclose in job listings the hourly rate or salary range for the position. Senate Bill 1057 also broadens the state’s equal pay law. The changes take effect Jan. 1, 2024.

Louisiana Requires Leave for Genetic Testing and Cancer Screening

Louisiana has enacted legislation (Senate Bill 200), which will require employers with 20 or more employees to provide leave to employees for genetic testing and cancer screening when medically necessary. The changes take effect Aug. 1, 2023.

Michigan Further Expands Nondiscrimination Law

Michigan has enacted legislation (Senate Bill 147), which prohibits all employers from discriminating against applicants and employees based on the individual’s termination of a pregnancy. The law takes effect on the 91st day after adjournment of the state legislature. The legislature is expected to adjourn in late December of 2023.

New York - NYC Delays Implementation of Minimum Wage for Delivery Workers

It was previously reported that on June 12, 2023, the New York City Department of Consumer and Worker Protection (DCWP) released the final rule  regarding the required minimum wage for app-based restaurant delivery workers. 

New York City has announced that the minimum wage rate requirements for delivery workers of third-party food delivery services scheduled to take effect on July 12, 2023 have now been postponed due to pending lawsuits.

Iowa Permits Employers to Provide Employee Wage Statements by Electronic Means

Previously, employers were required to mail wage statements, provide them at the place of employment, or provide employees with the means to view and print an electronic wage statement at the workplace. Per House Bill 2240, employers are now allowed to provide wage statements to employees via secure electronic transmission or other secure electronic means.

If the employee is unable to receive his or her wage statement electronically, the employee must notify the employer in writing at least one pay period in advance, and the employer must:
  • Send the statement to the employee by mail;
  • Provide the statement to the employee at the employee’s normal place of business during normal employment hours; or
  • Provide the employee access to view the employee earnings statement electronically and provide the employee free and unrestricted access to a printer to print the statement.

Effective: July 1, 2018
