Illinois Expands Equal Pay Law to Include African Americans as a Protected Class

Illinois has enacted legislation (House Bill 4743) that will expand the state’s Equal Pay Act to expressly prohibit pay differentials between African American employees and other employees. Previously, the Illinois Equal Pay Act prohibited pay differentials based on sex only.

New Jersey Paid Sick Leave Act Reminder

As noted previously, New Jersey Governor Phil Murphy (D) has signed into law the New Jersey Paid Sick Leave Act (the “Act”), which will provide eligible employees with paid leave for their own medical needs, those of a family member, or other covered reasons. 

The New Jersey Department of Labor and Workforce Development has released on its website the required notice that must be posted and distributed to all New Jersey employees under the New Jersey Paid Sick Leave Act.

Minimum Wage Update for Various Jurisdictions

12/01/18

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Iowa Permits Employers to Provide Employee Wage Statements by Electronic Means

Previously, employers were required to mail wage statements, provide them at the place of employment, or provide employees with the means to view and print an electronic wage statement at the workplace. Per House Bill 2240, employers are now allowed to provide wage statements to employees via secure electronic transmission or other secure electronic means.

If the employee is unable to receive his or her wage statement electronically, the employee must notify the employer in writing at least one pay period in advance, and the employer must:
  • Send the statement to the employee by mail;
  • Provide the statement to the employee at the employee’s normal place of business during normal employment hours; or
  • Provide the employee access to view the employee earnings statement electronically and provide the employee free and unrestricted access to a printer to print the statement.
Coverage: Employers with employees in Iowa.

Effective: July 1, 2018
