Medical Marijuana Law Enacted in Pennsylvania is Similar to Several Other States with Broad Anti-discrimination Provisions

Pennsylvania has joined the growing list of states legalizing the use of marijuana for medicinal purposes. On April 17, 2016, Pennsylvania enacted its Medical Marijuana Act (the “Act”) and, although the law takes effect on May 17, 2016, the State’s Department of Health must now go through the process of creating and implementing a regulatory program before its constituents can begin dispensing and using medical marijuana.

Minnesota Drug and Alcohol Testing Law Crosses State Lines

The United States Court of Appeals for the Eighth Circuit recently ruled, in Olson v. Push, Inc., that multistate employers with operations in Minnesota are required to comply with the Minnesota Drug and Alcohol Testing in the Workplace Act (“DATWA”), even at their non-Minnesota locations. Specifically, DATWA coverage is now extended to include any applicant or employee who: (1) is an employee or applicant of an employer operating in Minnesota, regardless of whether the actual or desired employment is located out-of-state; and (2) has “significant contacts” with Minnesota.

California Raises Minimum Wage to $15.00 per Hour and Amends Sick Leave Law for in-home Supportive Services

April 21, 2016

Governor Brown signed SB 3 into law raising the state minimum to $15.00 per hour by 2022.  California’s minimum wage currently is $10.00 per hour.  The new law also amends the existing paid sick leave law to provide paid sick leave to in-home supportive services employees beginning July 1, 2018.  The sick leave entitlement will provide up to one day of leave per year, and increase over time to three days per year.

Iowa Permits Employers to Provide Employee Wage Statements by Electronic Means

Previously, employers were required to mail wage statements, provide them at the place of employment, or provide employees with the means to view and print an electronic wage statement at the workplace. Per House Bill 2240, employers are now allowed to provide wage statements to employees via secure electronic transmission or other secure electronic means.

If the employee is unable to receive his or her wage statement electronically, the employee must notify the employer in writing at least one pay period in advance, and the employer must:
  • Send the statement to the employee by mail;
  • Provide the statement to the employee at the employee’s normal place of business during normal employment hours; or
  • Provide the employee access to view the employee earnings statement electronically and provide the employee free and unrestricted access to a printer to print the statement.

Effective: July 1, 2018
