San Diego Minimum Wage and Sick Leave Ordinance Now in Effect - Sick Leave Amendment Pending Enactment

Voters in the city of San Diego supported a ballot measure that imposes a citywide minimum wage and also requires employers to provide paid sick leave.  The ordinance is now in effect while an implementing ordinance (“IO”) amending the sick leave requirements remains pending. While the IO requires a second read before it is effective, the City Council has set July 11, 2016 as the effective date for employers to comply with the ordinance’s original requirements. This communication summarizes the current ordinance and highlights changes and clarification provided by the IO.

California Law Expands Ban on Smoking in the Workplace

7/7/16

California has amended Section 6404.5 of its Labor Code to expand its prohibition on the smoking of tobacco products in a place of employment.  In addition to bringing owner-operated businesses into the gambit of environments in which smoking is prohibited, the law eliminates most of the exemptions that permitted smoking in certain work environments, such as hotel lobbies, bars and taverns, banquet rooms, warehouse facilities, and employee break rooms.

Utah Requires Reasonable Accommodations for Pregnancy-Related Conditions

Utah Governor Gary Herbert signed legislation (Senate Bill 59) that requires employers with 15 or more employees to provide reasonable accommodations for pregnancy, childbirth, breastfeeding, and pregnancy-related conditions.

San Diego Voters Approve Minimum Wage and Sick Leave Ordinance

June 16, 2016

Voters in the city of San Diego supported a ballot measure that imposes a citywide minimum wage and also requires employers to provide paid sick leave.

This ordinance passed following a referendum vote on June 7, and will go into effect immediately following certification of the election results.  The certification process will likely conclude in mid-July 2016.

New York Increases Minimum Wage to $15.00 per Hour

New York Governor, Andrew Cuomo, signed legislation implementing a staggered set of regional minimum wage increases with the end goal of increasing the state’s minimum wage to $15.00 an hour by 2021.

Austin, Texas Passes Ordinance Banning Pre-Offer Inquiry into Applicant’s Criminal History – Reminder for all Clients Regarding Background Check Consent Form

Austin, Texas has enacted a city ordinance prohibiting employers from asking about or considering a job applicant’s criminal history before making a conditional offer of employment. Austin is the first city in the South to enact such a “Fair Chance” or “Ban the Box” law.  Please be reminded that clients taking advantage of ADP Screening and Selection Services should use the most recent version of the Background Check Consent Form which is available in the Forms Library in My TotalSource in the pre-employment section.

Vermont Enacts a “Ban the Box” Law - Reminder for all Clients Regarding Background Check Consent Form

Vermont has enacted a statute prohibiting most employers from requesting criminal record information on an initial application.

Iowa Permits Employers to Provide Employee Wage Statements by Electronic Means

Previously, employers were required to mail wage statements, provide them at the place of employment, or provide employees with the means to view and print an electronic wage statement at the workplace. Per House Bill 2240, employers are now allowed to provide wage statements to employees via secure electronic transmission or other secure electronic means.

If the employee is unable to receive his or her wage statement electronically, the employee must notify the employer in writing at least one pay period in advance, and the employer must:
  • Send the statement to the employee by mail;
  • Provide the statement to the employee at the employee’s normal place of business during normal employment hours; or
  • Provide the employee access to view the employee earnings statement electronically and provide the employee free and unrestricted access to a printer to print the statement.

Effective: July 1, 2018
